Private Investigator and Stalking

We had an unusual question from a new client that ask how private investigators can conduct surveillance without being considered “stalkers”. For clarity, being a licensed private investigator does not mean that we are exempt from stalking laws. A Private Investigator can stalk someone and be prosecuted for it, so the issue is about stalking in general and how one becomes a stalker. In general, stalking involves unauthorized contact with someone. It always involves multiple contacts and it must be reported. Once the “stalker” is made aware of the fact that they are not to follow, contact, etc. the person, then the stalking laws apply. In our business, if we are detected, the surveillance should end. That way no further contact is made and stalking does not occur.

Computer Spyware

Although we feel that the number of trash websites dedicated to selling spy ware, both good and bad products, is pathetic, many of these computer spyware products can help you to catch your cheating spouse. The computer is one of the main ways for people to communicate. Cheating spouses use this method to communicate all the time and having computer spyware installed can make a quick end to the lies. Hidden Video

We frequently have clients who ask about getting hidden video footage inside a place of employment, restaurant, hotel, etc. When faced with this type of surveillance, our investigators have hidden cameras that allow us to follow the subject or even sit next to them while filming them without any visible signs of a camera. Most of these cameras are stitched into a jacket, blazer or shirt. The recording devices are very small and allow us complete freedom of movement. We do have problems in some environments. Sporting events, airports, strip clubs and casinos are all areas where we cannot easily get a hidden camera inside.

Event Surveillance

When you need event surveillance (work function, concert, sporting event, etc.) at a large venue where tickets are required, more than one investigator is usually needed to get the job done correctly. Why? It is usually not possible to sit near the subject and monitor them for a long period of time. Accordingly, we need to watch them as best we can, coming and going, usually often. When you conduct this type of surveillance, you have periods of time where the subject is out of sight and can move away, only to be lost for the duration of the event. With multiple investigators, we can handle this in shifts and keep track of them the entire time. Unfortunately, that means a higher fee for you including the extra investigator and the tickets.

Timing of Surveillance

Timing of surveillance is everything. Despite how good your private investigator is at surveillance, the road conditions can make or break the surveillance. No one can keep up with an aggressive driver operating in heavy rush hour traffic in a major metropolitan area like Chicago, Los Angeles, New York, Seattle, DC, Miami, Atlanta, Detroit, Houston, Dallas or San Diego. If they do stay with the subject, the private investigators odds of being detected increases 200%. The only way to counter such obstacles is to use a vehicles tracker (where legal) or to utilize a second (or third) private investigator.

Calling cards

When your spouse is using a calling card to communicate with the person they are chaeting with, we cannot trace the calls. Unlike a land line or cellular telephone, there is no record of the calls made, just the dates and durations.

Recorded Phone Calls

If you have been recording your spouses telephone calls or are considering, please stop! Recorded phone calls are illegal! Even if it’s your telephone, it is against the law for you or a private investigator to record phone calls. Further, if you have recorded phone calls, please do not share this with us. Internet Profiling

As most Americans have embraced the internet as a part of daily life, we communicate and in some sense live on the internet. When we do this, we often leave traces of ourselves behind. Hotel Surveillance

Hotel Surveillance is one of the most problematic areas where a private investigator has to work. We are often asked to watch people traveling on business. Many of these cases involve the subject potentially having an affair with a co-worker, so our clients are always asking to see if these two people are staying in the same room. Well, think about the last few times you stayed in hotel. How much time did you spend in the hallway in front of your room? How many people were just standing around in the hallway reading the newspaper? Would you call security if you saw the same man standing in the hall an hour later (yes everyone else would)? Hotel Surveillance makes life a little difficult for us and sometimes it is impossible for us to get the proof you’re looking for. Your spouse can go back to his/her room and then have the other person show up an hour later, etc. etc. Sometimes we are lucky enough to be able to book the room directly across the hall from the subject, but those opportunities are rare. More frequently, we need multiple investigators to get the job done correctly.
